Counterfeit complaints 

If you are an Amazon seller who has been accused of counterfeit and had your seller accounts deactivated and/or your assets frozen, it is crucial that you understand what steps to take in order to get your account reinstated. When you are accused of violating an IP right and selling counterfeit products it can result in excessive fines, imprisonment, and it interferes with the seller contract you maintain with Amazon.

If a counterfeit claim is filed against you, you should first analyze the products you are selling to see whether there is any merit to the claim. Check the sourcing for all of your products and ensure you acquired your inventory through legitimate sources. If the counterfeit claim is truly baseless, then your next step is to reach out to the opposing party and provide proof of this as well as request that they complaint made is retracted.

If the opposing party refuses to retract the claim even though you have proved it is baseless with documentation of your sources, let them know you will report this infraction to Amazon if they do not comply in order to get your account reinstated. Typically, the other party will retract the claim for fear of legal action.
