There’s been a recent uptick in the number of Amazon sellers getting sued and having their assets frozen. In this video, we break down what’s been happening and what you can do to protect yourself.
Temporary Restraining Order (TRO)
A temporary restraining order (TRO) is a document issued by a court after a request from a brand is filed against numerous sellers for distributing counterfeit products. The brand will claim that without freezing the assets of the accused Amazon sellers that their business will suffer irreparable damage. This document is often requested from the courts in a furtive manner in an attempt to manipulate the situation, and when filed will force Amazon to freeze both the assets and inventory of the seller accounts.
Getting your seller account reinstated
In order to get your Amazon seller account reinstated after a TRO has been filed against you, there are several steps we will take.
- First, we will prepare a notice of appearance which alerts the courts that you are being represented by our law firm.
- Next, we will file a motion to dissolve; meaning that we will ask the courts to formally dissolve the temporary restraining order filed against your seller account. In many cases this can be done by demonstrating to the courts that it is unjust to freeze 100% of your assets, when the products under review only account for a small percentage of what you are selling.
- Lastly, we will file a motion to dismiss the case based on a variety of aspects including but not limited to; lack of jurisdiction or no merit to the allegations filed by the brand.
