Accused of Selling FAKE Items on Amazon? What To Do with a Counterfeit Product Complaint
What are your rights as an Amazon seller if a brand or brand manager accuses you of selling counterfeit products when your products are 100% genuine?
Well, you have a lot of rights!
You have civil claims, claims you can bring in a court of law against whoever made those baseless complaints. I’ll give you an example that we did, the Dallas Cowboys. You don’t believe me? Google “Rosenbaum Famularo Dallas Cowboys” and you’ll see what I’m talking about.
So, the civil claims that you have are defamation, defamation per se, and interference with your contract with Amazon.
All of these claims are valid if you are falsely accused of selling counterfeit products. Now, am I rushing you into court? Absolutely not. But you can use those legal claims to persuade whoever made those false claims against you to retract those complaints, and that is the ideal solution. That’s what you’re looking for. You want those complaints off your account, you want your account health to go back up. If you’re suspended, you want to be reinstated. So, use those legal claims as leverage to get the retraction that you need.
We do it, you can do it, and there’s nothing wrong with using the law to help you resolve things amicably.
If you can’t get the complaint retracted and you’re losing boatloads of money, then it’s time to get me on the phone. Be like “CJ, is this case worth pursuing?” We’ll do a financial analysis to decide whether or not it is worth it for you to go after whoever made those false counterfeit complaints against you.
