Brand Suing Amazon Seller with Zero Jurisdiction for Baseless Infringement Claims

What am I all fired up about this morning? I want to tell you about a case called Tangle, T-A-N-G-L-E. It’s a lawsuit filed in the Southern District of New York, my home courthouse. It’s filed by these guys from California who came to New York and started messing with the wrong seller.

Tangle Brand suing Amazon Seller:

They filed a lawsuit claiming they had jurisdiction in New York, even though our client never sold anything into the state of New York. They also claimed that our client sold infringing products when our client had absolutely zero sales. Nothing in New York, nothing infringing, nothing of their brand.

I get this lawyer on the phone and I’m like, “Hey, listen. Your case is totally bogus. You don’t have any jurisdiction in New York. You don’t have any sales at all. What are you doing here?” This guy wanted to extort money from our client. I stopped him and I said, “Hey, listen, buddy. You keep talking. I’m going to have to make a complaint against you, because what you’re doing sounds really, really wrong. Here is your chance to cut our client loose and we go away.”

You know what he did? He asked for $32,000. He asked for half of the money that he froze with this baseless temporary restraining order. Then you know what he did when he saw our papers? He reduced it to $5,000. You know what I told him?

Like the Godfather, I told the guy who wanted to extort money from him, “Here is my offer: zero. In addition to zero, you should pay our client’s attorney’s fees, and you should pay our client for their damages, and you should throw in some extra money for some pay-per-click advertising to get our client back.”

I added one more thing, that “Even though I don’t represent the other 67 or so defendants in this case, I’m going to do everything I can, everything I can to stop you, your law firm, and this brand from ever messing with sellers ever again.”
