Amazon Sellers are Sued w/ NO WARNING – How to Dissolve TROs
Amazon sellers, I hope you are never sued in a court of law, but if you are, I am the right person to talk to. And what I’m going to talk to you about today is when you get sued and you only find out about it when your Amazon account gets frozen.
You receive an email from Amazon that says “This brand sued you by this law firm.” Amazon is holding your inventory and your money. I’m going to tell you how we handle those cases for sellers, not only all over the United States, but all over the world.
First off, put in a formal response to the lawsuit. It’s called an answer. This protects from a default, which is really, really bad.
Then, you want to instantaneously demand information from the other side, under federal rule of civil procedure, FRCP rule 26. You’ll also want to as quickly as possible, prepare a motion to dissolve the restraining order that is freezing your account.
I can’t tell you how many of these orders are issued when they shouldn’t be issued.
You want to get the court to dissolve that order freezing your assets right now. Don’t wait. Those are the important things to know; Put a formal response to the lawsuit. Demand the information you’re entitled to and bring a motion to dissolve the TRO.
