Legal help with Walmart plan of action , Walmart seller appeal, Walmart Seller Suspension , Walmart Seller Termination and Walmart Marketplace seller issues.

If Walmart has stopped your sales, withheld your funds, or seized your inventory, we can help. Our team begins with a holistic review of the notice, your account history and any prior correspondence with Walmart as a starting point. From there, we help you develop and execute a case-specific strategy, including submission of a Walmart plan of action or Walmart seller appeal. A suspension, terminated account and payment hold can each require their own unique approach.
Rosenbaum & Segall, P.C., the law firm behind Amazon Sellers Lawyer, helps Walmart marketplace sellers assess and address issues facing their Walmart seller account. If you received a Walmart Performance warning, we can review your Walmart account issue, explain the available options and work with you to prepare and submit the appropriate response. Whether you need a Walmart suspension appeal or advice about withheld funds, we begin with your records and a clear understanding of your goal.

Understanding Your Walmart Seller Account Status

Walmart monitors the activities of Marketplace and Walmart Fulfilment Services (WFS) sellers. Walmart may suppress, pause, suspend or terminate your Seller Centre account if you don’t comply with Walmart’s Seller Retailer Policies and terms of service.

Status

What it means for your account

Suppression

Customers cannot purchase your seller-fulfilled items, which may appear as out of stock on Walmart.com. Your Walmart-fulfilled listings remain on the marketplace.
Pause
Customers cannot purchase either your seller-fulfilled or Walmart-fulfilled items. Both types of listings may appear as out of stock on Walmart.com.
Suspension
Both seller-fulfilled and Walmart-fulfilled listings become unavailable for purchase and cannot be found on Walmart.com. Your Seller Centre access is restricted, and payments are placed on hold. Accounts that remain suspended without a successful appeal or reinstatement may eventually qualify for termination.
Termination
Walmart removes all your listings and permanently revokes your selling privileges and Seller Centre access. Payments are also placed on hold.
If you violate any of the Seller Retailer Policies, Walmart will notify you through Seller Centre and by email, along with recommendations to help you address the issue.
Your Walmart plan of action or Walmart Seller appeal should address the specific status and relevant allegation contained in the notice. For a Walmart Seller Suspension, we review the alleged violation and all supporting documentation.  This typically includes your seller performance data, supplier documents, fulfilment arrangements and any complaints or letters you may have received from brands or rights owners.

How to Prepare a Walmart Plan of Action

If an appeal is available, Walmart usually requests a written explanation of the issue as well as the steps taken to correct it and measures taken to prevent it from reoccurring in the future. Depending on the issue type, Walmart may also request supporting documentation like invoices, supply chain records, or warehouse photos.
Our team can assist in drafting the response and organising the supporting evidence to address the actual allegation Walmart has raised. When operational issues occur, we need to explain the correction accurately and demonstrate that it will be maintained. For example, a promise to improve your late shipping rate does not explain why orders were late in the first place. Our Walmart seller appeal would address who handled fulfilment, when orders were passed to the carriers and what changed. This explanation should also be supported by records.

Walmart Seller Account Terminated

A Walmart Seller termination is a more serious notification than receiving a Walmart seller suspension. Walmart’s published appeal policy says terminated selling privileges cannot be appealed. A termination notice states that your selling privileges and any access to Seller Centre are permanently revoked due to violations and noncompliance. This is typically caused by repeated violations or failure to address a prior notification.
If you have a Walmart Seller account terminated, we can review your account history, termination notice and all prior communications to assess whether there is a viable basis for further action. That could include formally raising a factual dispute or a separate matter regarding withheld payments. We would explain the available options, their limitations, and the likely costs before recommending further action.

Responding to Walmart Trust and Safety Concerns

This broad policy label may leave you unsure what account activity Walmart is questioning. Under the Walmart Trust and Safety policy, any products deemed in violation of Walmart’s regulatory compliance, offensive product, or intellectual property policies will be unpublished and may experience restricted sales, account suspension or termination of your selling privileges on Walmart.com. Account inactivity and certain product-related issues can lead to action by Walmart Marketplace under the Walmart Trust and Safety policy.

Reason

What it means

Dormant account
Your account has had no activity for 455 consecutive days, including no sales, Seller Centre logins, or API usage through the Developer Portal.
Intellectual property
A product you’ve listed infringes on another party’s intellectual property rights.
Offensive product
A product in your listings is considered offensive under Walmart’s marketplace policies.
Regulatory compliance
A product you’ve listed does not meet applicable local, state, or federal laws and regulations.

Withheld Payments and Account Balances

Walmart’s policies provide for payment holds for a variety of reasons. If Walmart is refusing to release your funds, we can help review all relevant notices, assist in obtaining an explanation if needed, and identify whether there is a contractual basis to seek a demand for payment or other dispute resolution procedures.
Selling privileges, account access and payment release are handled differently. The next step will be fact specific to your case and will depend on the evidence available and the agreement governing your relationship with Walmart.

Walmart Intellectual Property Complaints and Listing Restrictions

Some Walmart Seller suspension issues affect individual listings before action is taken at the account level. As an Intellectual Property law firm focused on e-commerce and online businesses, we can efficiently review and handle trademark, copyright, patent and authenticity complaints, as well as related supply chain and authorisation documents.
Responding to an IP complaint on Walmart depends on the type of allegation being made against you. Trademark, Copyright and Patent allegations each fall under their own area of law and require different arguments and evidence to dispute them. We conduct a legal analysis of the complaint prior to recommending a response to Walmart or communicating with the rights owner.
