  • Step 1: A Patent Owner submits a request for Amazon APEX via Brand Registry in the form of a Utility Patent violation.
  • Step 2: Amazon notifies the sellers accused of infringement of the patent owner’s claim and provides a three week deadline for the seller(s) to either resolve the dispute with the patent owner and obtain a retraction of the complaint or agree to participate in the APEX program. Amazon will automatically suspend the accused listing if the seller does not respond to the notice.
  • Step 3: If one or more sellers agree to participate in the Amazon APEX program, Amazon then appoints a neutral evaluator (not a judge).
  • Step 4: Both sides submit written documents with limited arguments available based on the rules of the APEX program.
  • Step 5: The evaluator decides whether the accused product infringes based on the arguments submitted.
  • Step 6: Amazon enforces the result by either removing the accused listing or restoring its full access.

In a successful Amazon Apex proceeding, the seller is reimbursed for any expenses paid to the evaluator – instead, the patent owner is required to cover this cost. A poorly drafted APEX response can permanently remove ASINs, even if the legal basis is subjective or debatable. Design Patent Enforcement on Amazon:

Design patents protect the look or ornamental features of a product, not the way the product functions or is made. Amazon’s standard for design patent enforcement is very high:
