Consumers on Amazon Making Baseless Frivolous Claims Against AMZ Sellers – How We FIGHT BACK

Sometimes people buy your products, and sometimes they get hurt and it’s sucks. Sometimes the claims are totally frivolous. And to admit it, even though I represent sellers, sometimes your products can cause harm, and today I’m going to be talking to you about a personal injury case that we are defending on behalf of an Amazon seller.

The product was a water bottle, and the customer claims that he filled the water bottle up with tap water and somehow suffered insane burns.

Now, we know it’s impossible. There are charts available from the American Burn Association that show you the temperature that water must be at in order to cause significant burns, and there’s no way it happened the way the plaintiff claims.

The plaintiff’s lawyer first demanded $200,000 to settle. And as we fight the case, and as I use the skills that I earned, my hard-earned skills as a plaintiff’s lawyer before shifting into Amazon, from 200 to 150, 150 to 100.

Now the guy’s looking for $65,000. And my answer to him is, “Absolutely no, it never happened the way you described, and we’re going to fight you until it gets down to a number that is reasonable in light of the nonsensical story your client came up with.”

So, two takeaways about claims against AMZ sellers:

Number one, if you get sued because your product harmed somebody, you have to defend yourself.

Number two, you should have insurance. Amazon is telling you to get insurance, Amazon has required insurance for a long period of time, and if you don’t have insurance, you’re going to have to pay me out of your pocket.
