Section 3 suspensions are one of Amazon’s strictest forms of enforcement against sellers on their platforms. Rooted in violations of Amazon’s Business Solutions Agreement (BSA), Section 3 suspensions are often much more difficult to lift from sellers than other common forms of suspensions. What is Section 3 of the Business Solutions Agreement?

Section 3 of the BSA outlines Amazon’s terms for terminating their agreement with sellers and removing them from the platform. Here, Amazon outlines the timeline for termination as well as the various reasons for which Amazon would terminate a seller’s account:

  • Material breach of agreement with failure to address concerns within outline timeframe
  • Your account was used for the development or perpetuation of fraud or illegal activity
  • Your account has been used to harm the health of Amazon or other sellers’ accounts
  • Account health rating falls below the outlined threshold
  • Amazon is required to terminate your account by law

In most of these cases, Amazon attempts to give 30 days notice (during which you can appeal your termination), however, in cases where Amazon is required to terminate your account to comply with legal action, they will do so sooner than 30 days.

Importantly, Section 3 cases are often a next step of enforcement after previous compliance issues with Amazon’s terms. For sellers looking to avoid Section 3 suspensions, it is key to keep records of all communications with Amazon, and resolve outstanding issues on your account as soon as possible. Especially for suspensions involving potential legal issues (such as intellectual property violations), it is vital that sellers attempt to resolve these problems before Amazon escalates to Section 3 suspension.

Amazon Section 3 Reinstatement

Reinstating accounts from Section 3 is different from other cases because of the severity that a Section 3 case is compared to other suspensions. While other suspensions are often directly related to a compliance issue, Section 3 cases can be viewed as a breach of trust between you and Amazon that you must repair before you will be allowed to return to selling. This can mean providing more evidence for your case, taking more extensive preventative measures, and exiting product markets that led to any violations.

The first step to reinstatement is complying with any requirements that Amazon alerted you to in their Section 3 suspension notice. Because Section 3 suspensions are often due to continued violations, or failure to respond to Amazon’s requests for verification, resolving these ongoing issues will show your commitment to positive seller activity on the platform going forward. Particularly, verification of inventory, product testing, and any issues that involve outside legal matters (such as intellectual property violations) should be resolved before moving on to requesting reinstatement.

Next, completion of a Plan of Action (POA) appeal will officially put your case on the desk of Amazon’s enforcement team. In your POA you should have three sections: a root cause analysis, immediate corrective actions, and future preventative measures. Additionally, attaching supportive evidence to your POA is key to supporting the claims that you make in the rest of the appeal.

If initial POAs are not enough to secure account reinstatement, moving to escalated appeals and escalated action may help secure account reinstatement. These are often conducted in conjunction with a legal team, who prepares a pre-arbitration case that threatens further legal action if your account is not restored.
