Plaintiff is an Amazon Seller suing Amazon in New Jersey for trademark infringement, anti-trust violations and unfair practices claims after Amazon allegedly allowed other Sellers to sell similar products under Plaintiff’s trademark. Pursuant to the forum selection clause of the agreement, Seller entered into with Amazon prior to selling its products on Amazon’s site, Amazon asked the court to transfer this case to Washington.
