There are times when it makes sense to try and work out a settlement with the other party. But there are also times when it’s best to go to trial.

Should I pursue legal action?
As a a business owner you have the right to pursue any legal actions which you deem appropriate, but you should consider how you can best invest your time and money. You can do this by conducting a cost-benefit analysis in order to best analyze how you can make choices which serve your purposes and are least detrimental to your business.
Cost-Benefit Analysis
When considering whether to pursue legal action you should make a point of analyzing how you can minimize your losses and make the best decision for your business. This means that if the cost of litigation supersedes the amount that you intend to recover, it would be reasonable to settle because even if you win the case you will be loosing money.
This concept also applies to situations where you are being sued by a brand and must make the decision to defend yourself against the charges or to cease selling the products. If the price of defending yourself against the brand is higher than the amount you typically profit from selling the products, you may be better served by eliminating the cost of legal action.
