Here’s what you can do: You can file what is called a notice of preservation. You could submit that to the complainant themselves. Essentially, if you send them that letter, the threat is that this will be submitted to Amazon and Amazon will be required to preserve their documents, ESI, electronic storage information. This has been successful in the past. We submitted the notice of preservation to that supposed rights owner. I believe the same day they responded and they retracted either that day or the next day. You do need to reasonably anticipate litigation in order to submit that.
