Private Label Seller Suspended for Using Brand Name in Listing

We had a client who created a listing for his own trademarked item. His product was similar to another brand and product, so he wrote the brand name into his listing. He got a Performance Notification from Amazon stating that his listing infringed upon the trademark rights of a rights owner. He then reached out to Rosenbaum Famularo, PC for assistance.

We informed him that we could assist him to change his listing, the product detail page and help correct the error. We worked together with our client to come up with a good title that still had keywords but kept him in compliance with Amazon’s policies.

We then created a Plan of Action for him which was submitted to the seller performance team. It simply stated that our client had since created a new title and product detail page.

At our firm, we work collaboratively with other members of our team, as well as our client. We had one of our intellectual property attorneys review the Plan of Action to ensure there was no infringing language.
