Amazon Seller News Today: Amazon Business Solutions Agreement Changes Coming

Agreeing to Amazon’s Business Solutions Agreement (BSA) is required for all sellers on the platform. New changes to that agreement are going into effect on March 4th, 2026, requiring compliance for all active sellers. In this blog we discuss how the BSA is changing, what that means for sellers, and opportunities for arbitration against Amazon.

Amazon BSA Changes

The BSA is changing to add new policies around AI. The largest part of these changes relate to AI use on Amazon, now prohibiting unauthorized training of language models and adding provisions for Amazon to restrict the use of AI agents on the platform. Amazon’s new terms seem to give them more room to suspend accounts that they believe are AI agents not complying with their terms.

For Amazon sellers in Mexico, the United States and Canada BSA no longer mentions Mexico as Amazon Mexico has their own separate BSA. Amazon is also changing certain language in the BSA to clarify further terms. This includes adding “government authority” to the definitions section and further clarifying information about arbitration to Section 20. This does not modify the arbitration requirement in the BSA but should add more information about the function of an independent arbitrator.

Arbitration Against Amazon

Arbitration against Amazon is typically a later step of escalation in the process of appealing a seller suspension, releasing held funds, or attaining reimbursement for lost FBA inventory. The process begins with filing a demand for arbitration that is sent to both Amazon and the American Arbitration Association. This can be sent by your legal counsel or by you directly, but should include your dispute and the damages that you are seeking.

During pre-arbitration, you have the opportunity to settle if you are seeking a more expedited resolution to your dispute. Settlements often involve a capitulation on both sides, i.e. Amazon accepts faults but does not pay the full demanded amount to the seller. This does not have to be true though, in a recent Amazon Sellers Lawyer case, our attorneys initially came with a $250,000 demand, but were able to secure an over $280,000 settlement after presenting evidence to Amazon’s team.
