In our original version of this book, we discuss something that happened in July of 2017. We received many calls from multi-million dollar sellers stating that their accounts were suspended for having multiple intellectual property complaints.
Some of these sellers had more than two dozen IP complaints, and suddenly through July 5-7, their accounts were suspended. They called us in a panic, because they had tremendous payrolls to meet and no income to do this since their accounts were shutdown.
The way that we addressed all of these suspensions was that we handled the most recent intellectual property suspension first, then worked our way backwards. As soon as we had 5-10% of the complaints retracted, we drafted a plan of action and got all of our sellers reinstated.
Since that time, we have never seen such a huge wave of giant sellers suspended for the same reason over a short period of time. What we have seen over and over again is sellers who have received an IP complaint ignore the complaint, and then they get another and another, and then one day, their account is suspended.
They way to prevent this type of suspension is to address each complaint as it is received; do not let them accrue.
If you receive an intellectual property complaint, whether it be in trademark, copyright, utility or design patent, just address it immediately. The best way to keep your account healthy and to avoid suspensions is to address these complaints and get them withdrawn as soon as possible, even if it’s not an emergency. In the event that it is not an emergency, a seller can often negotiate a better deal with the rights owners who made the complaint and can point out that they did not violate their rights at all, or work out a licensing deal to resolve the issue.
