The PROCESS of How to Obtain Account REACTIVATION After Receiving Trademark Violations
Trademark violations on six different ASINs…. In this video, I’m going to be talking to you about how we obtained the account reactivation of an Amazon seller who had six violations.
Okay, Amazon sellers. So, whether it’s 1, 2, 3, 4, 5, or even six different trademark allegations against you, intellectual property right allegations made against you, the first line of attack is to go back to whoever made the complaint or complaints.
Sometimes it will be 2, 4, 5, 6 different brands making complaints, or sometimes it will be the same brand making a complaint against six ASINs. And you want to try and get a retraction. In order to get a retraction, you have to do the legal analysis as to whether or not you were violating their trademark rights.
Most sellers are not violating anybody’s intellectual property rights, because you’re selling genuine products, your sales are protected under the first sale doctrine.
So, what did Jacques do? He followed the program. He followed our process of getting Amazon sellers accounts reactivated. He followed our process of getting Amazon sellers listings reactivated by first doing an analysis and then reaching out to the complainant.
Now in this particular case, all six came from the same complainant and that complainant refused to respond.
Jacques then put together a killer plan of action with the root cause, immediate corrective action, long term changes to the business, and also attached our legal opinion letter that there was no violation at all, and also showed Amazon that the complainant refused to respond to our request for a retraction.
