What AMAZON Sellers NEED to KNOW Before Starting a Lawsuit & Bringing Claims to Litigation
Amazon sellers, private label sellers, big brands and small, in this video, I’m going to tell you when you should not sue. Where even if you have great claims, even if you got screwed or harmed, it’s just not worth suing.
So, here are the two times you should absolutely make a decision not to sue, regardless of what the lawyer is telling you:
Number one, your damages, the money you hope to recover is not at least three to five times whatever the attorney’s fees are going to be.
Every lawyer knows that litigation can be long, expensive, two years down the road, depositions, motions. It gets pricey really, really quickly. So whether you’re talking to me or some other lawyer, the lawyer should be able to anticipate the worst case scenario, what it’s going to cost you over the next two years, and unless the money you’re seeking is three to five times that amount, don’t proceed.
Number two, you have to have some place to collect the money.
Lawsuits are almost always about collecting money at the end of the day. So, if you think about it, you’re paying a lawyer, you’re engaged, you’re involved in the depositions, you’re putting your time and your effort and your money into this, and then you win a million dollars, but there’s no place to collect so therefore, what was the point?
Litigation is about making money when it comes to business, so the two times you should not sue, number one, your damages are not at least three to five times the cost of the lawyer. And number two, there’s no place to collect. So, if you have either those issues, don’t get involved, don’t sue, don’t write the check.
