Amazon Ghost Listings Suspension
One of the strangest issues for new e-commerce sellers to deal with is an issue known as ghost listings. These are product listings that exist on non-major e-commerce websites, with the primary purpose of deceiving automated systems on websites like Amazon. Because sellers are required to offer competitive prices for the same products as other online platforms, if another website has your product listed for cheaper, you can be required to change your price, or be suspended outright.
Often, these ghost listings are created with the goal of getting independent sellers out of a certain market, driving prices low enough to be unsustainable so other sellers can come in and take the business. Although this is not a common issue, many sellers, including a recent Amazon Sellers Lawyer client, have had their business seriously impacted by sudden requirements that they must change the pricing on their products.
In a recent Amazon Sellers Lawyer case, our team was contacted by a seller whose products were being advertised on a sketchy website at a lower price, leading to product removal on Amazon. Once taking the case, our team worked on gathering evidence about the sketchy website, as well as recent sales data that proved our client was selling products at an appropriate price.
As a result of Amazon’s strict policy on customer experience, securing product reinstatement required escalation to a pre-arbitration letter sent to Amazon’s team. This letter declared our intent to file for arbitration, a private legal proceeding, if they failed to resolve the suspension on our client’s products. After receiving this letter, Amazon lifted all suspensions, and our client was able to return to selling as normal.
Ungating on Amazon – Selling Branded Products
Throughout 2026 so far, Amazon has made several major changes to their policy on resellers that have tightened the hold that brand owners have on who is allowed to sell their products. The most important change to policy occurred in May, and now requires all sellers to attain an official reseller permission assigned by the brand owner, or show proof of manufacturer permission to sell products.
These changes have made the already difficult process of brand ungating more strict and difficult for independent sellers, who have been treated with increased scrutiny since new policies were implemented. Many sellers who had already received authorization have seen their products suspended, costing them time and money while Amazon reviews their case.
For one of our recent clients, the problem was specifically related to the registration of a new product which they had received authorization from by its manufacturer. Despite this, Amazon refused to allow their product to be approved for sale, leading them to contact our team for assistance. Immediately, we worked on gathering evidence of the client’s supply chain and their pre-existing approval from the brand owner for independent sale of the product. This allowed us to successfully ungate the product on first attempt, getting our client back in business
Intellectual Property Infringement Allegations
Some of the most common types of suspensions on Amazon relate to intellectual property based suspension, whether they be copyright infringement, patent infringement, or trademark violations. These suspensions are often caused by a direct report from the brand owner, or from Amazon’s automated systems, which work to detect and enforce potentially infringing products.
Recently, the Amazon Sellers Lawyer team was contacted by a seller who had been suspended for allegedly infringing a brand’s protected IP. Through working directly with the seller, we learned they were also the owner of a brand and that their products were not directly infringing on another seller. Instead, it was their product page which had several areas which needed to be changed in order for them to be reinstated.
We worked with the seller to remove any content that could potentially be targeted as violating someone’s protected brand, then submitted an Amazon Plan of Action appeal which was enough to reinstate their account.
