Amazon Sellers Lawyer major success stories — seller reinstatements, IP wins, and counterfeit appeal victories

Amazon Seller News: Major Successes From Amazon Sellers Lawyer

In the past few weeks, the Amazon Sellers Lawyer team has seen dozens of major success stories with our clients. In this blog, we use some of the most relevant success stories to discuss a variety of common topics for e-commerce sellers.

Amazon Appeals For Counterfeit Allegations

Allegations that you have counterfeit products on Amazon can be a major blow to any seller. Not only do your products and accounts face suspension, but you have the potential of facing legal threats if the alleging party chooses to pursue action against you. For this reason, it is vital that sellers facing these claims work to address them as soon as possible in order to avoid escalating action against you.

The Amazon Sellers Lawyer team was recently contacted by a client who faced six separate counterfeit allegations on their account. This led these listings to be suspended and put the seller’s whole business in jeopardy. We worked with them extensively to document the authenticity of their products, and were successful in securing reinstatement for all of the products.

Brand Approvals for Restricted Amazon Products

Certain products on Amazon are on a restricted list that requires approval before you are able to sell them. Restricted products include those which are restricted for either requiring testing, or being a protected brand that Amazon is worried about having counterfeit sales. These types of brands include things like Nike, SanDisk, and other major products which are sold first-party on Amazon.

Because Amazon is worried about the counterfeit sale of these products, getting approval to sell them on your own can be tough. Additionally, receiving approval for a product once does not mean that Amazon’s automated systems will not flag it again in the future. This is just what happened to a longtime Amazon Sellers Lawyer client recently, who reached out to us after getting flagged for selling the same brand he had been approved for months ago.

Using our knowledge of both the client and Amazon’s systems, we worked with him to create an appeal which highlighted his approval for sale of the products. This helped to secure reinstatement for his brand privileges, clearing the allegations, and getting him back to selling products like normal.

Suspected Intellectual Property Infringement

Like counterfeit allegations, intellectual property (IP) issues should be addressed as soon as possible as they threaten both your account and have the potential to spiral into litigation. While IP suspensions are difficult to deal with, something that many sellers do not know how to address is a suspected IP allegation.

Because Amazon increasingly relies on automated systems to flag products for suspected violations, these systems often make errors or repeatedly classify a product as infringing when it has already been approved. This was the case recently when a seller reached out to us with suspected IP violations that he believed were false.

The difficult aspect of suspected IP violations is that Amazon’s preferred way of having sellers address them is through the removal of potentially infringing content. For sellers who are not infringing, this can be difficult as there are few options to prove to Amazon that you are selling valid products.

When our client contacted us, we immediately got to work compiling evidence that showed they had the rights to all content they were using on their storefront. Through direct work with Amazon’s enforcement team, we were able to resolve all outstanding suspected IP violations, and helped the seller get back to focusing on growing their store.

Single Mom Targeted By Litigation on eBay

A few weeks ago, the Amazon Sellers Lawyer team was contacted by a single mother who runs an eBay shop. This seller had been targeted by litigation which was going after her businesses and threatening her livelihood. Despite reaching out to over 20 other lawyers, this seller was repeatedly denied because these lawyers thought her case was unwinnable.

That’s when our attorney Brian Malkin stepped in, taking the case and working with her to secure a settlement. Within a week of her reaching out, the two attained a settlement that helped to ensure that she could continue running her business. This case represents both a major litigation victory for our team and a major moral victory for helping to ensure that independent sellers like her can continue providing for their families.
