Negotiations & AMZ Litigation – How to Settle Your Case if You’ve Been Sued
“CJ, I can’t believe it. I got sued. They actually filed a lawsuit against me. I thought their threats were just a bunch of hot air, but they actually sued me. What do I do?”
Okay. So I just had this conversation with a particular seller. What do I do? This is what I explained to the seller…
Number one, hire us or another lawyer who knows both litigation and Amazon inside and out.
I believe me and my team at Amazon Sellers Lawyer are the best in the world, because before getting involved solely with AMZ sellers, all I did is litigate cases. I was the guy in the courthouse. So what you need to do is file a formal response to that lawsuit.
Number two, if there’s a Temporary Restraining Order (TRO) against you, try and get that TRO lifted. (For more posts about TROs, you can read more about it by clicking here).
Number three, put yourself in a position of strength.
Number four, try and negotiate a resolution to the litigation.
This is for all AMZ litigation. The last thing you want to do as an Amazon seller is to be stuck in protracted litigation. You want to get to a point where you can negotiate from a position of strength, then try and resolve the issues.
