What is a Baseless IP Claim?
A baseless claim is made when someone makes a complaint against a seller account for violating intellectual property law, but there is no legitimate evidence to support the claim being made. Baseless claims of counterfeiting have been made by accounts that have not gathered proof to support their accusations, and likely want to minimize competition on Amazon.
How does a Baseless Claim Affect my Seller Account?
When a baseless claim is made against a seller on Amazon, the seller’s account is suspended and they are unable to distribute inventory and/or make a profit. It can also negatively affect the reputation of an account when there are claims of counterfeiting made against them, so it is important to take action against false accusations in a timely fashion.
What can I do to combat Baseless Claims?
When someone is making baseless complaints against you, you have the choice to handle these claims by contacting the account that has reported you and warning them that you will take legal action if they do not retract their claims.
You can also report the account that made baseless claims against you directly to Amazon so that the complaint made against you is removed and Amazon ignores new complaints of this kind. When brands make baseless claims against other sellers they violate Amazon’s seller agreements by appearing to commit fraud, which provides you the opportunity to report them to Amazon, with evidence that their claims are false, for effective remediation.
