AMAZON SELLER GOT SUED OVER ALLEGATION OF SELLING EXPIRED PRODUCTS

If you are an Amazon Seller, it is important to be aware of the dangers of selling expired products. Recently, a seller was sued by a brand who alleged that they had sold expired products.

In this video, I will discuss what happened in the case, and offer some advice on what Sellers can do to protect themselves in the event of a similar situation. My advice to Amazon sellers, don’t be afraid and follow the steps I mentioned in this video.


Products with expiration dates

We recently represented an  Amazon seller who was sued under the allegation that the vitamins they were distributing were at or too near to the expiration date. In this case, we entered into a settlement agreement where the brand agreed that they would accept the unsatisfactory inventory and replace it with products whose expiration date was not for a significant amount of time.

What to do

If you are an Amazons seller who lists products that have an expiration date, make sure that when you purchase inventory you have enough lee way time to sell the products before they are close to expiring. In addition to this, if you are threatened with litigation, look for ways to resolve the discrepancy outside of court in order to be most time and cost effective.

One of the best ways to resolve disputes is through a business agreement. A business agreement is a legally binding contract between two parties which dictates conduct which is accepted in the relationship.
