How to Seek Damages from Baseless Counterfeit Complaints through Defamation Per Se on Amazon
Hi everyone, my name is Alexa. I’m a paralegal with Rosenbaum, Famularo & Segall, P.C. and today I’m talking about what you can do if you’ve received a baseless counterfeit complaint.
So in terms of Amazon, and you may have received a bunch of baseless counterfeit complaints from one brand or company, we’ll call them brand X for this video. They may have caused your account to be suspended, or you to not be able to sell that brand in its entirety. If you have a bunch of items in your inventory and buy items in your warehouse, you’re letting these products go to waste.
If this has caused you loss of sales & harm because your account is suspended, you may be able to seek damages through ‘defamation per se’ if you have authentic invoices that prove your products are legitimate.
Defamation per se is pretty much saying, brand X has hurt my relationship as the seller, with Amazon and may cause me to get suspended again down the road, or may cause other issues in the future. So this is trying to protect you and your reputation as a seller with Amazon, from these baseless complaints.
