How Has the Covid-19 Pandemic Impacted Arbitrations with Amazon & What You Should Know

Arbitrations against Amazon in the age and era of COVID-19.

Okay. So we’ve been handling arbitrations against Amazon for Amazon sellers well before the pandemic began, during the pandemic, and we will also continue to do it as the pandemic subsides and things return to normal.

The way it’s working during the pandemic is really not that much different than it was pre-COVID in that you’re still entitled to hearings, as long as it’s a domestic arbitration, and that you could do them by phone or by video. Now, the difference is that all the arbitrations are by phone or by video, but before the pandemic, during and I believe afterwards, you will still be able to do your arbitrations by video link or by telephone.

Now, generally, I like hearings to be in person because when it’s David the Seller versus the Goliath of Amazon, I think it’s usually better for the arbitrator to meet you in person, see you speak in person and really get that rapport and that feeling about you. Now, I’ve also had clients where I did not want the arbitrator meeting them in person because I thought they would make a poor witness in their own behalf, but if you come across as credible and nice and warm and caring, then an in-person hearing is much, much better. And then after the pandemic, if you’re bringing the arbitration, you will get to decide whether it’ll be an in-person hearing or telephone or video.
