IP TIPS: How to Obtain Licensing Agreements on Amazon After Infringing Activity

If you’ve been accused of violating somebody’s patent and you’re violating intellectual property rights, this video is for you.

Many Amazon sellers get caught up selling products that unknowingly violate another person’s or another company’s patent rights. And today I’m going to be talking to you about a utility patent.

A utility patent is basically how a product functions.

So, our client bought a bunch of goods, was selling them on Amazon and got hit with a legal letter by a law firm, and also a complaint on Amazon that their products were violating this other company’s utility patent. So we have patent council on board. We reviewed it carefully, and we came to the conclusion that unfortunately, the claims were right.

So then, what are we going to do for our client? We worked with that law firm. They know us from prior cases and we negotiated a license agreement that our client can continue to sell the product. They’re going to pay a per unit fee to the rights owner. And at the end of the day, everybody’s happy.

Our client is okay because he’s still making a profit. Maybe not as much as he had hoped, but he’s not losing his shirt on this truckload of products that he’s selling. And the rights owner is really happy because the rights owner turns out is not all that adept at selling on Amazon. So everybody is happy. It’s a win-win situation. Our client is out of the litigation.

Being the number one law firm in the world, and I don’t say that lightly, we are the best, the largest law firm in the world, focusing solely on Amazon. And by carrying that seriousness, that experience with us, allows us to negotiate agreements for you, where even if you’re wrong, you can still get back into business, making money.

So if you have any particular issue with obtain licensing agreements, submit your case to us. We respond to you because we know you need help. You need a voice. You need someone to stand with you with all the challenges you face as an Amazon seller.
