Don’t Get Sued & Defend Yourself as an Amazon Seller Fighting Product Sourcing Claims

All right, this information is for every single seller around the world sourcing products through Alibaba or really through any factory in China.

You often will get sued or have claims made against you where one law firm is trying to sue dozens or even hundreds of you at the same exact time, claiming some type of patent evaluation. Many sellers have no idea the strength, the weapons that you have to fight these, to stand up, get these cases dismissed.

So what I’m going to talk to you about today is called the America Invents Act of 2011. Lawyers refer to it as the AIA.

What I want to talk to you about is when these law firms start these lawsuits against dozens or hundreds of you, and they’re claiming a patent violation, you have the right to have your case severed, your case taken out. Their case against the dozens or hundreds of sellers, you can ask the judge to dismiss it, because they’re not supposed to bring on more than one defendant at a time.

So if you’re sourcing products in China, if you’re sourcing through Alibaba, if any lawyer has threatened you with a patent complaint against you or brought an action against you, you need to know your rights and your right is to compel those lawyers to bring individual cases, which send their costs through the roof.

A lot of these lawyers are on contingency fee arrangements where like a car accident or a medical malpractice, they’re getting a cut of the recovery. So therefore they want to keep their costs low. They don’t want to be stuck suing you individually. They want to sue hundreds of you at the same time to save time and money. But you have the right under the America Invents Act of 2011 to say, no, no, no, no, no. You want to come after us, you do it one at a time. And by the way, if you’re going to come after me, you better do it in a state that actually has some power over me, not some state that I never did any business with.
