What’s going on with Prop 65, and why do sellers need to know about it?

Well, Prop 65 is a special rule in California that protects consumers. Proposition 65 requires businesses to provide warnings to Californians about significant exposures to chemicals that cause cancer, birth defects or other reproductive harm, etc.

If you sold products that ended up within California’s borders, you may receive a complaint either from Amazon that someone is asserting a Prop 65 claim against Amazon, and you need to hold Amazon harmless, you need to defend Amazon, you need to indemnify Amazon… Or, you might receive it directly.

Under any of those scenarios, you absolutely need a lawyer.
